1. Acceptance of Terms

By accessing or using giftech ("Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Platform. These terms apply to all visitors, users, Sellers, and Buyers.

2. Platform Role

giftech provides the infrastructure that enables individuals and businesses ("Sellers") to create online stores and sell products to customers ("Buyers"). giftech is not a buyer, seller, distributor, or agent of any products listed. All transactions occur solely between Buyers and Sellers.

3. Eligibility

To use giftech, you must:

  • Be at least 18 years of age
  • Provide accurate, current, and complete information
  • Comply with all applicable local and international laws

4. Seller Accounts

To create and maintain a store, Sellers must:

  • Provide accurate registration and KYC details
  • Use a valid, monitored email address
  • Comply with third-party payment provider (e.g., Paystack) requirements
  • Receive manual approval from the giftech team before going live

Giftech reserves the right to approve, reject, suspend, or terminate any account at its sole discretion.

5. Fees and Payments

Free Plan: 5% transaction fee per sale, automatically deducted.

Pro Plan: ₦5,000/month with 0% platform transaction fees.

Payments are processed by third-party providers. Giftech does not store or process payment card details. Platform fees may be updated at any time with prior notice.

6. Third-Party Services

Giftech integrates with third-party services for payments, communications, and data storage. These services are governed by their own terms. Giftech is not responsible for their performance, service failures, or external fees.

7. Seller Responsibilities

Sellers are fully and solely responsible for:

  • Product accuracy, descriptions, and high-quality imagery
  • Pricing, stock availability, and inventory management
  • Order fulfillment, packaging, and delivery logistics
  • Timely customer communication and after-sales support

8. Product Listing Standards

All listings must be accurate and not misleading. Images must represent the actual product being sold. Pricing must be transparent, and any limitations (e.g., shipping zones) must be clearly disclosed. Giftech may remove non-compliant listings.

9. Prohibited Products and Activities

Users may not sell or promote:

  • Illegal goods, counterfeit items, or stolen property
  • Drugs, controlled substances, or weapons/explosives
  • Adult or sexually explicit content
  • Fraudulent schemes, Ponzi programs, or deceptive services
  • Intellectual property infringements

10. Orders and Fulfillment

Sellers handle all aspects of processing and shipping. Giftech does not guarantee product quality, delivery timelines, or the professional performance of any Seller.

11. Refunds and Disputes

Refund and return policies are set by individual Sellers. While Giftech does not guarantee dispute resolution, we reserve the right to intervene in cases of confirmed fraud, platform abuse, or repeated policy violations.

12. Customer Communication

Sellers must maintain professional conduct, provide accurate order updates, and avoid any misleading, harassing, or abusive behavior toward Buyers or Platform staff.

13. Platform Integrity

Sellers must not bypass the platform to avoid fees, request off-platform payments for listed items, or redirect customers away from giftech after initial engagement. Violation may result in immediate termination.

14. Account Security

Users are responsible for maintaining the confidentiality of their credentials. You are liable for all activities occurring under your account.

15. Service Availability

The Platform is provided “as is”. Giftech does not guarantee uninterrupted access, error-free operation, or that the service will meet specific business requirements.

16. Limitation of Liability

Giftech is not liable for indirect, incidental, or consequential damages, including loss of profits or data. Our maximum liability is strictly limited to the fees paid by you to us in the 3 months preceding the claim.

17. Termination

We may suspend or terminate accounts without prior notice. Upon termination, stores are removed, and data may be deleted after 30 days. All outstanding financial obligations remain payable.

18. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved exclusively in the courts of Lagos State.

19. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after such updates constitutes your explicit acceptance of the revised Terms.
